[일본뉴스 3/20] 도쿄고등검찰, 대법원 특별항고 포기..."하카마다 사건 재심 시작"

57년 전 시즈오카현에서 일가족 4명이 살해된 이른바 '하카마다 사건'에서 도쿄고등검찰은 하카마다 이와오씨의 재심=재판의 재시도를 인정한 도쿄고법 결정에 대한 특별항고를 단념했습니다.향후 재심이 열리게 됩니다.

하카마다 이와오씨(87)는 1966년 현재의 시즈오카시에서 된장 제조회사 전무 일가 4명이 살해된 사건의 범인으로 지목돼 사형 판결이 확정됐습니다.

그러나 2014년 시즈오카 지방법원으로부터 재심을 인정받아 풀려났고, 지난 13일 도쿄 고등법원도 검찰 측의 즉각 항고를 물리치고 재심을 인정했습니다.이 결정에 대해 도쿄고검은 최고재판소에 특별항고할지 검토하고 있었지만, 오늘 특별항고를 단념한 것으로 나타났습니다.

향후 시즈오카 지방 법원에서 재심이 열리게 됩니다.도쿄 고등 법원에서의 심리의 쟁점은, 사건으로부터 약 1년 2개월 후에 현장 근처의 된장 탱크에서 발견된, 범인의 것으로 여겨지는 5점의 의류의 혈흔의 「색」이었습니다.도쿄 고등 법원은 재심을 인정한 결정으로 「1년 이상 된장 절임된 의류의 핏자국은 붉은 빛이 소실된다」라는 판단을 나타내, 붉은 빛이 있는 의류가 발견된 것에 대해 수사 기관에 의한 조작의 가능성에까지 발을 들여놓았습니다.

 

57年前、静岡県で一家4人が殺害されたいわゆる「袴田事件」で、東京高検は袴田巌さんの再審＝裁判のやり直しを認めた東京高裁決定に対する特別抗告を断念しました。今後、再審が開かれることになります。 袴田巌さん（87）は、1966年に現在の静岡市で味噌製造会社の専務一家4人が殺害された事件の犯人とされ、死刑判決が確定しました。 しかし、2014年、静岡地裁から「再審」を認められ釈放されていて、今月13日、東京高裁も検察側の即時抗告を退け、再審を認めました。この決定について東京高検は最高裁に特別抗告するか検討していましたが、きょう、特別抗告を断念したことが分かりました。 今後、静岡地裁で再審が開かれることになります。東京高裁での審理の争点は、事件からおよそ1年2か月後に現場近くのみそタンクでみつかった、犯人のものとされる5点の衣類の血痕の「色」でした。東京高裁は再審を認めた決定で「1年以上みそ漬けされた衣類の血痕は赤みが消失する」との判断を示し、赤みがある衣類がみつかったことについて捜査機関によるねつ造の可能性にまで踏み込んでいました。
